Squatter Eviction to Be Supervised By Law in Kenya

A Bill seeking to regulate future forced evictions of people occupying illegal land was introduced in the House yesterday for the first reading. The Evictions and Resettlement Procedures Bill, sponsored by Kisumu Town East MP Shakeel Shabbir, seeks to protect people occupying land from unlawful and non-procedural evictions.

The purpose of the bill is to lay out procedures to be followed before, during and after the forced evictions of all individuals occupying land unlawfully. If the Bill is passed into law, then no persons shall be forcibly evicted from their homes or their property demolished without a court order authorising the eviction.

In cases where forced evictions will be authorised by a court, a 21-day notice shall be given to the affected persons and the notice shall clearly state the modalities, day and time of the forced evictions.
